Jaclyn Malyk is a founding partner and seasoned litigator in the state and federal courts of New Jersey, New York and Pennsylvania. Ms. Malyk focuses her practice on commercial litigation and insurance law.
Ms. Malyk represents corporations in connection with commercial contract disputes, spanning the gamut of subject matter, including franchise agreements, commercial leases, property transfers, software services agreements and many others. Ms. Malyk has also represented insurance companies in complex insurance coverage disputes arising out of long-tail environmental contamination and toxic torts.
Ms. Malyk also litigates ERISA and non-ERISA disability and accidental death benefits claims, life insurance rescission and lapse actions, and life and annuity interpleaders. She leads the firm’s interpleader program. Ms. Malyk’s experience includes representing companies in health care litigation, including preferred provider network disputes with health care providers, health insurance plan disputes with participants and providers arising out of denial of coverage for experimental treatment and other bases, and disputes amongst plan sponsors and third-party administrators.
Ms. Malyk gained invaluable experience during her tenure in the in-house law department of a Fortune 100 life insurance company, which lent her greater insight and understanding about her clients’ business concerns and challenges. Ms. Malyk continues to give transactional advice on state insurance and annuities regulations in connection with the development of new products and the operation of existing products. Ms. Malyk further advises on litigation readiness and has been instrumental in fostering program-wide proactive approaches to discovery to increase success and cost-effectiveness. Ms. Malyk has been selected for inclusion by SuperLawyers from 2023-2025.
